Notice Entitlement
If you are not given your full notice or are not paid in lieu of notice, you can claim statutory notice from the RPS. Any additional contractual notice should be claimed in the insolvency.
These are key points in the statutory entitlement.
-
Once you have worked 2 weeks, you are entitled to one week notice. After two years, you are entitled to 2 weeks notice. Thereafter, for each complete year you are entitled to another weeks notice up to a maximum of 12 weeks.
-
Payment for notice worked but not paid is subject to the statutory limit of £700 a week and deduction of tax and national insurance (prior to 6 April 2024 the limit was £643).
-
Payment for notice not worked is viewed as a compensation payment for breach of contract.
-
It is important that you take all steps possible to keep your loss during your notice period to a minimum. This includes claiming all available benefits, including Jobseekers' Allowance at the JobcentrePlus.
